CONDITIONS for booking with
HASHPOINT SURF CAMp SARL
These Booking Conditions, together with our privacy policy and where your holiday is booked via our website, our Website Terms of Use, together with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with Hashpoint Surf camp SARL, located Rue Tayoughte 107, Taghazout, Agadir, Morocco. Fiscal nr 40130170 (“we”, “us”, “our”). Please read them carefully as they set out our respective rights and obligations. In these Booking Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.
By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:
A. he/she has read these Booking Conditions and has the authority to and does agree to be bound by them;
B. he/she consents to our use of personal data in accordance with our Privacy Policy and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);
C. he/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services;
D. he/she accepts financial responsibility for payment of the booking on behalf of all persons detailed on the booking.
PRICES AND PAYMENT
All prices for packages are in euros and per person per week/7 night unless otherwise stated. Prices for Bed and Breakfast are shown per night. Upon making your booking the price of your holiday will not normally be subject to change, however, we reserve the right to increase or decrease prices due to variations in service charges, offers, insurance/security levels, or exchange rates. Once a booking has been made discounts cannot be applied retrospectively. A deposit of 50% is required at the time of booking. Once we receive your deposit we will secure your booking and send you a confirmation. The deposit is due 2 weeks after your booking date. If the deposit has not been received by this date we reserve the right to treat the booking as a cancellation. The remaining part is paid on arrival. Should the booking be made within 4 weeks of the arrival date, 100% of the total amount is required immediately.
CANCELLATION
If you are obliged to cancel your booking please let us know immediately by email. The following sliding scale determines if your holiday is refundable: 6 weeks and more - 100% refund 6 - 4 weeks before arrival date - loss of 25% (half deposit) 4 - 0 weeks before arrival date- loss of 50% of holiday cost (full deposit) If you wish to shorten your stay or cancel pre-booked add-ons while you are here, there is no refund for your remaining days or pre-booked add-ons. SURF GUIDING Surf-guiding does not include teaching or expert advice. You need to be able to manage yourself in the water. The surf guides will take you to surf spots and suggest where to surf but are not in any way responsible for clients' safety or for injury or death whilst surfing. When booking Surf guidance, you must be aware of your own surf level. It is possible that our surf guide will conclude that you do not have the required level to participate in guiding and place you with the intermediate group.
TRANSPORT PICK UP/DROP OFF
It may sometimes be necessary to combine, on certain transfers, customers arriving or departing on more than one flight. It may require additional waiting time at your airport or bus station. Sometimes our airport transfers are contracted to a specialist local agency. The maximum waiting time at the airport is 60 minutes. Please note departure times are 3 hrs prior to your flight departure from our accommodation. Surf packages with a minimum stay of 7 nights benefit from free airport transfers.
OWN RISK
● To enter Africa/Morocco you need a valid International Passport or visa. If you are rejected at Check-in at the airport and you are not allowed on the airplane, your deposit is non-refundable.
● When booking a holiday with Hashpoint Surfcamp everyone must have full travel insurance. Hashpoint Surfcamp accepts no responsibility for loss, theft, or damage to persons or property during their stay. Guests must obtain their insurance independently. ● It is your responsibility to ensure you have a suitable level of fitness and swimming to undertake our surf lessons. Any medical expenses or related costs incurred during your trip are not the liability of Hashpoint Surfcamp.
● Hashpoint Surfcamp’s equipment will be used for surf lessons or guiding unless previously agreed. If you damage or lose any Hashpoint Surfcamp equipment, always inform a member of Hashpoint Surfcamp staff and understand that you will have to pay for any repairs or replacements. We do offer surfboard insurance of €36 per week.
● If you get injured before traveling you have 2 options; Depending on your injury we might be able to adjust your package. If you are traveling with a friend, their booking stays as it is and it’s possible to pass on your place to another friend. If you both decide not to come the normal cancellation policy is applied. SURFBOARD INSURANCE Accidents can happen and most travel insurance does not cover damage to surfboards or fins. We offer insurance for just € 36,- a week / €6 a day that covers any damage to our equipment (wetsuits, surfboards, fins & leashes). If you choose not to add the insurance and you damage the equipment the charges are at your own risk. Meaning, we charge the costs of repairs or 50% of the board's cost if you snap it. This can vary between €100 and €500
SURF AND WEATHER CONDITIONS
In the event of poor weather or poor surf conditions, the passenger shall have no claim against Hash Point Surf Camp. With poor surf conditions, there are other options like Paradise Valley or Hammam, in this case, the excursion fee is added to your booking. There is no discount on no-swell days. EXCURSIONS If you decide to join an excursion instead of the daily surf lessons/guiding there will be no discount on your package. Excursions are only subject to refund when Hashpoint Surf Camp is not able to organize them due to unexpected circumstances or when the required minimum number of participants is not reached. Hashpoint Surf Camp decides if an excursion can take place or not. Excursions are Paradise Valley or Sandboarding.
Prepaid Yoga is non-refundable.
HOLIDAY TERMINATION AND INDEMNITY
While staying with Hashpoint Surfcamp, clients are expected to behave in an orderly and acceptable manner and are expected to accept responsibility for the conduct of themselves and their party. Should their behavior threaten the condition of the accommodation or vehicles or seriously impair the enjoyment of other guests, Hashpoint Surfcamp reserves the right to refuse to further accommodate the guilty party and contractual obligations will be terminated. The guilty party will be liable for the cost of any damage caused. EVENINGS OUT We are not responsible for outings other than those provided in the surf package. We do not officially organize evening outings. It is the client's responsibility to decide to join/attend a party elsewhere than the Hashpoint surf camp. Hashpoint Surfcamp accepts no responsibility for loss, theft, or damage to persons or property during their stay. ANIMALS It is not allowed to bring street cats or dogs or food for animals into the surf house. Hashpoint Surfcamp reserves the right to refuse to further accommodate the guilty party and contractual obligations will be terminated. The guilty party will be liable for the cost of any damage caused.
